By accessing this website or engaging services from Be The Art Studio (“Studio,” “we,” “us,” or “our”), you agree to the following Terms & Conditions. Please read them carefully.

1. Services Offered

Be The Art Studio provides photography services, including but not limited to portrait, boudoir, fine-art, and experiential photography sessions. All services are customized and collaborative in nature.

Details of each session, including scope, timing, and deliverables, are discussed and agreed upon prior to booking.

2. Booking & Payment

  • A session is not considered booked until a deposit or full payment (as agreed upon) is received.

  • Deposits are non-refundable unless otherwise stated in writing.

  • Remaining balances are due prior to or on the day of the session unless alternate arrangements are made.

Pricing is subject to change at any time but will not affect confirmed bookings.

3. Cancellations & Rescheduling

  • Clients may reschedule once with reasonable notice (typically 48–72 hours).

  • Cancellations made with insufficient notice may result in forfeiture of the deposit.

  • Be The Art Studio reserves the right to reschedule due to unforeseen circumstances (illness, emergencies, unsafe conditions, etc.). In such cases, all reasonable efforts will be made to accommodate the client.

4. Creative Process & Artistic Discretion

By booking a session, you acknowledge that photography is a creative process and that artistic style, editing choices, and interpretation are part of the service.

While client input is welcomed, final creative decisions—including composition, lighting, and post-processing—remain at the discretion of Be The Art Studio.

5. Image Delivery & Usage

  • Final images are delivered digitally unless otherwise agreed.

  • Turnaround times are discussed in advance and may vary.

  • Be The Art Studio retains copyright to all images unless a separate licensing agreement is provided.

Clients are granted a personal use license for delivered images. Commercial use requires written permission.

6. Model Release & Privacy

Clients will be asked to sign a model release prior to the session.
Participation in marketing, portfolio use, or publication is always optional and respected.

Your privacy and comfort are core values of Be The Art Studio. Images will never be shared without consent.

7. Client Responsibility

Clients are responsible for:

  • Arriving on time

  • Communicating boundaries, needs, or concerns

  • Ensuring their own physical and emotional well-being during the session

Be The Art Studio provides a supportive environment but does not offer medical, therapeutic, or psychological services.

8. Limitation of Liability

Be The Art Studio is not liable for:

  • Personal injury during sessions unless caused by gross negligence

  • Loss or damage to personal property

  • Unforeseen technical issues beyond reasonable control

Liability is limited to the amount paid for the session.

9. Website Use

All content on this website—including text, images, and design—is owned by Be The Art Studio and may not be copied or used without permission.

Unauthorized use may result in legal action.

10. Governing Law

These Terms & Conditions are governed by the laws of the State of California.
Any disputes shall be resolved within California jurisdiction.

11. Changes to These Terms

Be The Art Studio reserves the right to update these Terms & Conditions at any time. Updates will be posted on this page with a revised date.
